TERMS & CONDITIONS OF CHARTER
For the Terms and Conditions, Warrior Sport Fishing will be known as ‘WSF’ and the person making the Booking for themselves and on others’ behalf as the ‘Client’.
1. BOOKINGS AND PAYMENTS
(A). Payment is required in two installments, the first as a 50% Deposit of the group total to secure your charter date, followed by the Balance as a 50% installment, one week before departure. If payment is not met prior to charter departure the Captain retains the right to leave unpaid passengers onshore.
(B). The Booking is finalized and your date is secure once a minimum of 50% deposit, liability and photo release forms have been received by WSF and the best mobile phone number for contact on the morning of charter has been provided to WSF.
(C). The final balance payable is the difference between the 50% deposit and the number of people initially booked with WSF. If there is a change to numbers you must notify WSF no later than 7 days before the trip or you will need to pay for the absent people in order to cover lost income.
(D): Prices are subject to change without notice, however once officially booked with WSF the price remains as per the date of booking. Should the charter be postponed more than twice for any reason then pricing will revert to the current pricing.
(A). Cancellations will occur if WSF deems the charter to be dangerous to passengers due to weather, which is wind, tide, weather and swell dependent and also requires significant local knowledge. In the event of unsuitable weather, the captain has the final say in all charter cancellations so contact him the night before your trip. In the instance of a cancellation the charter will be rescheduled to a mutually convenient date and if there isn’t one, payment will be refunded to the Client.
(B). It is your responsibility to check in with the captain no later than 6pm the day prior to your trip to confirm trip details.
3. CANCELLATIONS AND NO-SHOWS
(A). The Client must give at least 8 days’ notice for full cancellation, or the Client will be held accountable for total cost of charter. The Client must give at least 14 days’ notice for changes to numbers, or the Client will be held accountable for total cost for the people who have cancelled. If the Client fails to inform WSF of changes prior to this time then they are liable for the full cost of the numbers booked.
(B). If there is a passenger no-show, the Client who initially booked for them will be liable to cover their costs, due to loss of income.
(C). In the instance of a cancellation by WSF where a mutually convenient rescheduling cannot be reached, the Client will receive a refund of all money paid.
(D). If you are running late, don’t worry, we’ll wait for you. However, the clock on your fishing trip does start running from the time you are supposed to depart, not from when you actually get there.
4. REFUND POLICY
If WSF deems the weather conditions to be unsuitable for charter departure and a suitable replacement date cannot be arranged then WSF will give full refund. Refunds are not available for any other reason unless otherwise agreed upon in writing. It is understood upon booking that while aboard WSF the captain’s decision is final on all matters. The Captain reserves the right to terminate the trip without refund.

8+ Days: 50% of total booking cost (deposit only)
7 Days & Under: 100% of total booking cost
While we have a very good track record of catching what we fish for, catching fish aboard your charter is not 100% guaranteed. No refunds will take place if you are unsatisfied with your charter. If we find that there has been loss or damage to our equipment or vessel due to negligence or unruly behavior then the customer will be liable for replacement or repair of the item. Prices are subject to change without notice. At Warrior Sport Fishing we do our very best to ensure that our customers are happy with our service and have a great time out on the water. If you have any questions, issues or any feedback, good or bad, we would like to hear it so that we can make Warrior Sport Fishing the best that it can be!
6. 100% MONEY BACK GUARANTEE
We strive to provide you with the best possible service and offer you every possible opportunity to work out any disputes or issues that may arrive. Your satisfaction is important to us. On the other side of the coin, if you had a great time, and we’re sure you will, please drop us a note and tell us so on our Facebook, Yelp or TripAdvisor account. Unfortunately, not catching any fish during your charter is not part of the Money Back Guarantee. But we will try our absolute best to make it happen.
We will never share your e-mail address with anyone else under any circumstances without your express permission, and will never sell your e-mail address to anyone. We value your privacy and your security. All online transactions are processed without a human eye ever seeing your credit card or bank account information, and are processed with the highest level of encryption currently available for your safety.
8. OTHER POLICIES
These charters all subject to the following rules of etiquette, at the discretion of our captains. You may not be allowed on the boat if you:
1) Show signs of intoxication
2) Show signs of infectious disease
3) Are pregnant or otherwise physically at-risk for adventurous activities
4) Are unruly or otherwise disrupt the enjoyment of the other participants or put the crew at risk in any way
This list is not all-inclusive, and enforcement is the sole responsibility of the captain or crew. If the captain crew determines that there is a violation of any safety or health standard, we cannot be responsible for a refund. If the boat shown on the website is not available on the day of the charter for any reason, we will substitute another boat of the same size and quality.
9. CHARGEBACK POLICY
This reservation will show up on your credit card statement as “Warrior Style Sport Fishing, LLC”
If you have a complaint about any service we provide, please contact us first. Customer satisfaction is very important to us, and we strive to stand behind the services that we offer. We will make every attempt to ensure that you are completely satisfied with the services we’ve provided you. If you are unhappy with our services for any reason, please do not file a chargeback with your credit card before you have given us a chance to work it out with you. Fraudulent chargebacks (chargebacks filed for services you did receive or issues that are listed in the terms and conditions herein) will be assessed a $25.00 fraudulent chargeback fee and a $20.00 collection fee (charged by the credit card company, not us), and will be pursued through a collection agency. We know you wouldn’t do that, though, would you?
10. DISCLAIMER (AKA THE “CYA CLAUSE”)
The services advertised on this website are provided by independent contractors and not agents or employees of Warrior Sport Fishing, LLC or it’s affiliates. Warrior Sport Fishing, LLC or it’s affiliates are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
The Website works as a middle-agent between the client and the operator of services listed on the Website. As such, the Website creates the necessary commercial connections in compliance with its own service and quality standards to provide services such as, but not limited to, fishing and snorkeling charters. Only the most reputable suppliers are selected for this purpose. However, the Website cannot be held liable for their acts, omission, wrongdoing or other. Travel services are subject to the conditions set by those suppliers, and their liability may, in turn, be limited by their tariffs and conditions of service. The Website acts only in its role of agent for the client or for the supplier of the goods and services rendered and as such, does not keep any legal authority or control over the operator’s personnel, assets, operation and/or property.
The Website herewith declares that:
(a) Photographic material published on its Website is intended to render a general depiction of the service in question and by no means can be guaranteed that the service will be supplied exactly as depicted.
(b) Travel services descriptions are regularly updated for a depiction of the product as close to reality as possible. However, the Website cannot be held accountable for variations occurring upon your arrival at the travel service site.
(c) The Website will reserve the right to deny the supply of a service to any client at any given moment if and when it considers convenient to do so.
(d) Any claim or comments that the client should present about the services received must be submitted in writing within a period of time no longer than 14 days from travels end date.
The Website will not assume liability for any claims, costs or expenses arising from personal injuries to the client or third parties, or caused by accidents, fatalities, loss or damage to personal property, lack of enjoyment or claims over emotional and mental states such as upset, disappointment, anguish, distress or frustration, or any other damage, whether physical, mental or emotional, arising from the following:
(a) Acts committed or omissions caused by any party other than the Website or its employees.
(b) Illness, theft, labor disputes, mechanical failures, quarantine, government actions, weather or any other circumstance beyond direct control of the Website.
(c) The client’s failure to obtain the required travel documentation such as, but not limited to, passports, visas and certificates, in which case no refund will be granted.
(d) The client’s failure to comply with travel instructions such as, but not limited to, tour dates and times, meeting locations, or other instructions.
(e) Changes to, or cancellation of, the travel services offered, notwithstanding the reason. The Website reserves the right to cancel or change the travel services at its discretion, but will try to substitute them with comparable services. If a reservation must completely be canceled, the Website’s liability will be limited to a refund of all monies paid to the Website.
